Terms
and Conditions of sale
Unless
otherwise agreed to in writing, all goods sold or offered for sale
by Colonial Lighting hereafter referred to as “CLA“,
are done so subject to the following conditions. |

QUOTATIONS
Quotations given are valid for a period of 30 days. Orders placed
outside this period may be subject to rise and fall adjustments. Price
Quoted is based on the quantity received and any variation in the
quantity ordered from this quotation, we reserve the right to adjust
quoted prices. All prices EXCLUDE 10% GST Prices are F.I.S. Sydney
for invoice values of $250-00 or more |

DELIVERY
Every effort will be made to complete this contract by any delivery
date promised. However late delivery or non-delivery due to circumstances
beyond CLA’s control shall not constitute a breach of contract
by CLA and CLA shall not be liable for any loss or damage howsoever
arising through such late delivery or non-delivery. The choice of
the carrier and method of transport remains with CLA, unless the
buyer pays for transport. CLA will only deliver products to the
premises of the purchaser, Deliveries direct to work site at the
request of the purchaser will become the responsibility of the purchaser
immediately upon despatch by CLA |

INSPECTION
AND ACCEPTANCE OF GOODS
Upon delivery of goods buyer shall inspect goods at its expense
and give written notice to seller within 48 hours of receipt of
any damaged goods or breakages. Stating full details of damage to
enable replacement to be provided. |

RETURN
OF GOODS
Under no circumstances can credit be considered on goods returned
unless the original invoice number accompanies the goods and the return
of the goods has prior authorisation from seller. Under no circumstance
can credit be considered unless all goods, returned at buyers cost
are undamaged and enclosed in original packing. For undamaged goods
returned within 30 days from the date of invoice a minimum 20% handling
fee applies. Goods will not be accepted for credit after 30 days from
the date of invoice without prior authorisation and applicable handling
fee will be affixed. Special products made to order, which are not
part of our standard product offering, will not be accepted for return
under any circumstance. |

SAMPLES
Samples will not be forthcoming until Official order has been placed.
On receipt of a customer’s purchase order sample will be supplied
for quoted projects. Invoices will be issued stating for SALE of RETURN.
Credit will be given on samples returned in original cartons and conditions
within a three month period of supply. |

GUARANTEE
All goods manufactured by, and or sold under the brand name Colonial
Lighting are guaranteed for one year from date of delivery against
faulty materials and/or workmanship, subject to the following conditions:
I. Goods are to be used under normal operating conditions,
mounted and connected with due care and according to relevant Australian
Standards, or in accordance with generally accepted practices.
II. Goods must be returned to CLA’s Sydney
factory within 14 days of the detection of the alleged fault, in good
order and condition. Wilfully damaged or defaced goods are excluded
from this guarantee
III. CLA cannot be held responsible for products
damaged by fire, storm, water or other components or parts not supplied
by CLA, or any condition not caused by the operation of the products.
IV. CLA reserves the right to request that the complete
piece of equipment containing the allegedly faulty component be returned
to CLA for inspection and testing.
V. CLA cannot be held responsible for goods damaged
in transit or during assembly and installation.
VI. CLA will not accept any charges for the replacement
of any CLA product unless consent to carry out such work is given
in writing by CLA prior to commencement of work.
VII. CLA will not be responsible for products that
have not been subject to a periodical maintenance program. |

PAYMENTS
Unless otherwise stated are strictly nett and payment in full shall
be made within thirty days of the date of invoice. Goods remain the
property of CLA until paid in full. |

PROPERTY
OF GOODS
CLA supplies goods on the condition that property of the goods does
not pass until they have been paid in full, but the goods are at risk
f the purchaser as soon as they have bee delivered to or into custody
of the purchasers Agent. |
